GENERAL TERMS AND CONDITIONS FOR THE HYTECON ONLINE SHOP

1.    Area of application
These General Terms and Conditions (as amended from time to time; hereinafter referred to as “GT&C”) are an integral part of all contracts between a customer (“customer”) who purchases items via the platform [www.hytecon.com] (“Hytecon online shop”) and Hytecon AG (as owner and operator of the Hytecon online shop) (“Hytecon”).

2.    Conclusion of contract
2.1.    Contractual partner(s)
When ordering items via the Hytecon online shop, the customer’s contractual partner is HYTECON AG, Brunnhalde 10, 6006 Luzern, Switzerland.
2.2.    Binding nature of the prices
Our information on goods and prices within the ordering process is subject to change and non-binding.
2.3.    Acceptance
By clicking the “Buy now” button, you place a binding order for the items in the shopping cart. We will confirm receipt of your order immediately by e-mail after you send your order. A binding contract is concluded upon receipt of the order confirmation.
2.4.    Changes
Amendments to the contract or the GT&C must be made in writing; any GT&C on the part of the customer shall not apply.

3.    Prices and shipping costs
3.1.    Prices
The prices listed in the offer at the time of the order shall apply. The prices quoted are final prices, i.e. they include the applicable statutory VAT and are quoted in euros (€). 
3.2.    Shipping costs
Shipping costs to customers within the European Union are included. Only outside the EU will shipping costs be charged separately; you can see the costs incurred here in the ordering process. In the event of a possible revocation, the costs shall be borne by the customer.

4.    Payment
4.1.    Payment methods
Hytecon generally accepts payment via credit card and PayPal. For every order, Hytecon reserves the right not to offer certain payment methods and to request other payment methods. Please note that we only accept payments from accounts in Switzerland and the European Union (EU). Any costs attached to a money transaction are to be borne by the customer. Cheques are not accepted.
4.2.    Retention of ownership
The delivered goods remain the property of Hytecon until full payment has been made. 
4.3.    Form of invoices and reminders
The customer agrees to receive invoices and reminders in electronic or paper form.

5.    Delivery of goods
Hytecon does not undertake to procure any goods ordered (Hytecon does not assume the procurement risk). Hytecon is only obliged to supply items from its own stock of goods. 
6.    Guarantee/warranty/right of return
6.1.    Guarantee/warranty
The period for the assertion of warranty claims is 2 years and begins with the delivery of the goods to the buyer. During this period, all defects subject to the warranty obligation will be remedied free of charge or the goods will be replaced by goods free of defects. The warranty claims are limited to replacement delivery or rectification of defects to the exclusion of all other claims, in particular for direct and indirect damage, consequential damage caused by a defect, indirect and direct damage and loss of profit. Hytecon decides at its discretion about a replacement delivery or rectification of defects. Warranty claims related to defects resulting from improper handling and use of the purchased item will not be entertained (see operating manual).
6.2.    Customer’s right of return 
For all purchases in the Hytecon online shop, Hytecon grants you a total right of return of 14 days from receipt of goods. Within this period (the period starts on the day of receipt of the goods), you can withdraw from the content by sending the goods back to Hytecon. Timely dispatch is sufficient to meet the deadline. However, a prerequisite for exercising the right of return is that you return the goods complete, unused and undamaged. The goods must also be returned in their original packaging. 
6.3.    Refunds
We will automatically arrange for any refunds to be made to the account you used for payment. If you paid by PayPal or credit card, the refund will be transferred to the associated PayPal or credit card account.

7.    Data protection
The protection of your personal data is important to us. You will find more information on how we handle your data in our data protection declaration.

8.    Copyright and trademark protection
All copyrights and trademark rights to the images, graphics, texts etc. used are held by Hytecon or its partners. Usage is not permitted without express agreement.

9.    Final provisions
9.1.    Invalid clauses
Should individual provisions of the contract or these GT&C be or become void, ineffective or unenforceable, the remaining part of the contract or the GT&C shall not be affected. In the event of the invalidity, ineffectiveness or unenforceability of a provision, it shall be replaced by a new provision whose purpose comes closest to the original purpose of the invalid, ineffective or unenforceable provision. The same procedure shall be followed if an omission becomes apparent.
9.2.    Applicable law and place of jurisdiction
The entire contractual relationship between the customer and Hytecon (in particular, all sales contracts concluded via the online shop) shall be governed exclusively by Swiss substantive law (the UN Convention on Contracts for the International Sale of Goods CISG as well as any other intergovernmental agreements shall not apply). The parties agree that the exclusive place of jurisdiction shall be Lucerne, Switzerland.
